1. Terms and Definitions

1.1. The Agreement is the present agreement between the Site Owner and the Site User. 1.2. The Site is the collection of web pages hosted online at the following URL: http://www.sochireporter.ru.
1.3. The Site Owner is the domain holder for sochireporter.ru.
1.4. The Site User is any person registered at the Site in due order.
1.5. The User's Profile is the section of the Site, accessible to the User after registration, where the User can store information and manage his or her account.
 

2. Agreement Scope

2.1. This Agreement governs the relationship between the Site User and the Site Owner, eventuated by the Site usage.
2.2. The Site User's registration implies that the Site User accepts all conditions of the Agreement and is obliged to follow them.
2.3. The Site User is informed that the Site content, excluding the Users' Profiles or other information if explicitly stated, is subject to the Site Owner's copyright.
2.4. According to this Agreement, the Site Owner isn't responsible to provide the Site User with Internet access.

3. Rights and Responsibilities of the Parties

3.1. The Site User is liable to:
   3.1.1. Use content of the Site (texts, creative products, photographs or any other copyright objects) only with sanction from and with a mandatory reference to the copyright owner.
  3.1.2. Adhere to the Terms of Use for the Site, established by the Site Owner (Terms of Use for the Site are available at the following web page: ________________).
  3.1.3. Provide his or her real full name during registration at the Site.
  3.1.4. Follow restrictions and limitations, specified at Section 4 of the Agreement.

3.2. The Site User is entitled to:
  3.2.1. Provide information about himself or herself, including any creative products and photographs, and post comments at the Users' Profiles or other sections of the Site.
  3.2.2. Apply with a question or a proposal to the Site Owner in accordance with the Terms of Use.

3.3. The Site Owner is liable to:
  3.3.1. Provide the Site User with access to the User's Profile via the Internet.

3.4. The Site Owner is entitled to:
   3.4.1. Delete from the Site (including the User's Profiles) any information, the publication or any other use of which is a violation of Russian legislation.
  3.4.2. Update this Agreement unilaterally.
  3.4.3. Update the Site (including its graphic design) unilaterally.
  3.4.4. Suspend or block the Site User from the Site or the User's Profile for indefinite term in case of breach of the Terms of Use or this Agreement, or violation of Russian legislation by the Site User.
 3.4.5. Delete the User's Profile (his or her account) in case of multiple or gross breach of Terms of Use or this Agreement, or multiple or gross violation of Russian legislation by the Site User.

3.5. Rights and responsibilities, established by this Agreement for the Site User, are created at the moment of Site User's registration at the Site, provided it was performed in due order.

3.6. The Site User allows other Site Users and the Site Owner to access, view, reproduce or otherwise use all of his or her content for personal purposes.

4. Restrictions and Limitations
  4.1. The Site User is forbidden to:
    4.1.1. Advocate or propagate social, racial, national or religious intolerance, war, or social, racial, national, religious or language supremacy.

4.2. Publish copyrighted content at the Site without having the required rights to do so.     

4.3. Publish on the Site or communicate via the Site's personal messaging feature any text messages, images or other materials, which are offensive for Site Users or other persons, or may be perceived so, including messages, images and any other content libeling Site Users and other persons, containing threats, calls to violence, breach of law, antisocial and immoral acts, or any other activities aimed at undermining the basis of law, order and morality.

4.4. Publish on the Site any messages, images or other materials, the publication of which may harm honor, dignity, or business reputation of a person or an organization.

4.5. Publish on the Site any pornographic materials, references and hypertext links to web sites serving such materials. Publish on the Site or communicate via the Site's personal messaging feature any restricted (private) information, if the Site User is not the owner of this information, which is the person who created the information or obtained the right to disclose it or limit access to it under law or agreement, or is the owner of this information, but does not have the required rights to disclose it in such a manner because of restrictions imposed by law or agreement by which he or she has obtained the rights to this information.

4.7. Publish on the Site any messages containing obscenities.

4.8. Provide during the registration or enter afterwards deliberately false or fictional personal information about himself or herself, including other person's name.

4.9. Publish on the Site any personal information, including contact information, belonging to any other Site Users or other persons. without their prior consent.

4.10. Use the Site for any commercial purposes without the Site Owner's prior consent.

4.11. Publish information on the User's Profile or in any other section of the Site, if this restriction is imposed by Russian legislation or the Terms of Use.

4.12. Use Site content (images, photographs, texts and other products) for any purposes other than personal.

5. Liability of the Parties and Dispute Settlement. Guarantees

5.1. The Site User is accountable for any unlawful use of Site content in accordance with Russian legislation. The Site Owner shall not be deemed responsible for any Site User's actions which violate Russian legislation or international law, as well as laws of any other nations.

5.2. Any possible disputes between the Parties shall be settled by negotiation. If the dispute remains unresolved, the infringed Party may take legal action in an arbitration court at the place of the Site Owner's current location.

5.3. The Site User guarantees that publication at the Site or distribution via the Site's personal messaging feature of any information, full or partial copies of copyrighted materials, or any other products doesn't violate anybody's legal rights or legitimate interests.

5.4. The Site Owner shall not be deemed responsible for any losses suffered by the Site User because of reasons caused by hardware or software malfunctions, or losses caused by the Site User's actions that go against reasonable rules for handling online information, hardware or software.

5.5. The Site Owner notifies the Site User that disclosure (breach of privacy) of information, i.e. actions resulting in public availability of information otherwise restricted by law (being state secret, official secret, trade secret, professional secret etc.) without the owner’s consent, as well as unlawful use of copyright objects (works of art, literature, science, computer programs and databases, audio recordings etc.), including online publication of their copies or parts, is punished by Russian civil, administrative and criminal law. 6. Concluding Provisions 6.1. Should any provision of this Agreement be deemed void or invalid (fully or partially), this provision should not be executed and is not considered a part of this Agreement (to the degree it was deemed void or invalid); all other provisions of the Agreement remain in effect. 6.2. In other matters, not regulated by this Agreement, the Parties rely upon applicable Russian legislation.
